Legal and strategic advice in respect of major mixed use regeneration schemes including housing, retail (in centre and out of town), leisure, employment, education facilities, minerals, waste disposal and recycling

General planning law advice on applications for planning permission, prior approvals, advertisements, hazardous substances consents, certificates of lawfulness, enforcement and abuse of local authority powers.  Also, advice on the preparation of local plans, neighbourhood plans and supplementary planning documents including procedural and constitutional requirements

Advice relating to heritage assets including listed building consents, appeals, unauthorised works, enforcement, urgent works notices, repairs notices and compulsory acquisitions

Planning appeals including advice on grounds of challenge and political process, preparation of evidence, costs applications and administration of public inquiries

Advice relating to High Court actions including instigating and resisting judicial review claims, statutory challenges and injunctions

Planning and highways agreements under Section 106 of the Town and Country Planning Act 1990 and Sections 38 and 278 of the Highways Act 1980 including advice on modification and discharge

General highways law advice in respect of the discharge of local authorities’ statutory duties and powers relating to maintenance liabilities, removal of obstructions, licensing of interference with public highways, retaining walls.  Also, advice on rights of way matters including closures, diversions and definitive map modification orders and public inquiries

Compulsory purchase proceedings (both promoting and opposing orders) including public inquiry work

Detailed knowledge and experience of planning committees and the political imperatives of the planning system within local authorities
