Appeal Success and Costs Award for Yorkshire Housing
We are pleased to have acted for Yorkshire Housing in a successful planning appeal relating to the development of 72 dwellings in North Yorkshire, including obtaining a full award of costs against the local planning authority. The proceedings themselves related to the refusal of an application for reserved matters approval, which was refused on alleged design and heritage grounds.
Alec Cropper provided strategic advice and support throughout the appeal process, including drafting substantive statements and structuring the evidence. He also led in managing the proceedings for the client, coordinating the consultant team and working alongside heritage and design experts in presenting the case in favour of the development. Alec said of the decision:
“This is an excellent outcome, not only in securing approval for the scheme, but also in obtaining a full award of costs in the client’s favour. We look forward to continuing to assist Yorkshire Housing in enabling this development to come forward”.
Stephen Hughes, Planning Manager at Yorkshire Housing commented that:
“Having worked with Alec from Walton & Co on previous schemes, I had no hesitation in instructing him to act on our behalf for this appeal. Alec provided commercially sound advice from the outset and approached the case with skill, expertise and due diligence, helping to refine the work of other consultants involved in the scheme to ensure that we put forward the strongest case possible.
He expertly dealt with the rebuttal to the Council’s Statement of Case and 3rd party representations and led on the successful costs award against the Council. We are delighted with the outcome and would happily recommend Walton & Co’s services to others.”
